NUTANIX .NEXT ON TOUR SOCIAL MEDIA CHALLENGE – OFFICIAL RULES

Eligibility: The Nutanix Netherlands B.V. .NEXT On Tour Darmstadt Social Media Challenge (“Nutanix”) Challenge (the “Challenge”) is open to all registered attendees of the Nutanix .NEXT on Tour Darmstadt event (“Event”) who are age eighteen (18) or older (“Eligible Participants” or ‘’You’’ or ‘’you(r)’’).  Participation in the Challenge constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules. VOID WHERE PROHIBITED.

To Enter:

• Participants need to collect their free t-shirt at the T-Shirt Printing Station.
• Participants need to take a photo in front of the designated Arch at the entrance area.
• Participants need to post the photo on a public social media platform (e.g., LinkedIn) using the hashtag #NEXTconf.

Prize: one (1) Montblanc ballpoint pen

Notification of Winners: Each eligible entry will be automatically entered into the prize draw for one (1) Montblanc ballpoint pen. The winner will be notified via the email address used for registering to the Event within 7 days of the draw. Winners must claim their prize within 7 days of notification. If the prize is not claimed within this period, a new winner will be selected.

Indemnity and Limitation of Liability: By entering the Challenge, you further agree to release, indemnify, defend and hold Nutanix and its affiliates, subsidiaries, directors, officers, employees, and agents, including advertising and promotion agencies, and assigns, and any other organizations related to the Challenge, harmless, from any and all claims, injuries, damages, expenses or losses to person or property and/or liabilities of any nature that in any way arise from participation in the Challenge or acceptance or use of a prize or parts thereof, including, without limitation, (a) any condition caused by events beyond Nutanix’s control that may cause the Challenge to be disrupted or corrupted; (b) any injuries, losses, or damages (compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in the Challenge; and (c) any printing or typographical errors in any materials associated with the Challenge. Winners agree to be bound by these Official Rules, and Nutanix’s decisions in all respects relative to the Challenge are final.

IN NO EVENT WILL NUTANIX BE LIABLE TO YOU FOR ANY DIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF USE, DATA, BUSINESS OR PROFITS) ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION IN THE CHALLENGE, WHETHER SUCH LIABILITY ARISES FROM ANY CLAIM BASED UPON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, AND WHETHER OR NOT NUTANIX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you.

General Rules: By entering in the Challenge: (i) you represent and warrant that by entering into or winning this Challenge that you are not in violation of your employer’s policies, rules or regulations; (ii) you are not in violation of any national or local government laws or regulations; and (iii) you agree to be bound by these Official Rules. The Challenge is offered by Nutanix, which is not responsible for (i) late, lost, delayed, damaged, incomplete, illegible, misdirected or undeliverable entries, responses, or other correspondence, whether by e-mail or otherwise; or (ii) phone, electrical, network, computer, hardware, software program or transmission malfunctions, failures or difficulties.

Nutanix reserves the right, in its sole discretion, to cancel, modify or suspend the Challenge in whole or in part, in the event of fraud, technical or other difficulties or if the integrity of the Challenge is compromised, without liability to the entrant or entrant’s employer. Nutanix reserves the right to disqualify any entrant or winner, as determined by Nutanix, in its sole discretion. Nutanix reserves the right to change the terms of or cancel this Challenge at any time. The Challenge is subject to these Official Rules and all applicable national and local laws and regulations apply. As stated above, the Challenge is void where prohibited or restricted by law. By participating in this Challenge, you acknowledge that you have read these official Rules and agree to abide by them and by the decisions of Nutanix, which are final and binding on all matters pertaining to the Challenge. These Official Rules are governed by the laws of the Netherlands, excluding rules governing choice of laws. Any action, suit, or case arising out of, or in connection with, this Challenge or these Official Rules must be brought in the competent courts of the Netherlands.
